How current is the data? +
The CFIUS Appendix A installation list reflects the December 2024 revision (the most recent as of this writing). Installation coordinates are from the DoD MIRTA dataset, August 2025. USDA AFIDA holdings data is from calendar year 2024. We notify Law Firm Plan subscribers when the dataset is updated following a regulatory revision.
How is distance calculated? +
Distance is calculated using the Haversine great-circle formula from the query point (parcel centroid) to the centroid of each installation in the Appendix A database. This is point-to-point measurement. For large installations, the actual boundary-to-boundary distance may be shorter. The Haversine result is conservative for determining threshold proximity and is noted as such in the report methodology section.
What is the Part 3 ICBM county check? +
31 CFR Part 802 Appendix A includes 48 counties associated with the three active ICBM missile wings: the 90th Missile Wing (F.E. Warren AFB, covering counties in Colorado, Nebraska, and Wyoming), the 341st Missile Wing (Malmstrom AFB, Montana), and the 91st Missile Wing (Minot AFB, North Dakota). Coverage for these counties is county-level, not radius-based. If you provide a county FIPS code, CFIUSCheck checks it against this list. The tool identified Chinese-linked AFIDA holdings in Weld County, Colorado (90th MW), which is one of the findings formally submitted to USDA and Treasury.
Can I use this for client filings? +
Reports may be used as supporting documentation in client files and due diligence records. They are generated from primary-source government data, are timestamped, include a unique report ID, and cite their methodology in detail. They are not a substitute for legal analysis by qualified CFIUS counsel. Many practitioners use proximity analysis tools as a starting point for their own independent assessment; CFIUSCheck is designed to serve that function efficiently.
